This Privacy and Cookies Policy (NYPY’s “Policy”) (together with and any other documents referred to within it) is intended to be ancillary to NYPY’s Terms of Business (and accordingly words and phrases defined or interpreted within NYPY’s Terms of Business likewise apply within this Policy).

Information NYPY collects from you
NYPY collect and process some or all of the following types of information from you in the course of providing our services, in particular your use of the online courier intermediary service, whose functionality is accessible via www.nypy.co.uk (including related domains), via the “NYPY app” and, in the case of Couriers, the “NYPY Work” app (“NYPY Service”):

Details of your visits to any website operating the NYPY Service, including, but not limited to, traffic data, location data, weblogs and other communication data, and the resources that you access.
NYPY process information relating to a booking or potential booking between a Client and the Courier as set out in paragraph 5.14 of NYPY’s Terms of Business, as a data processer and on your behalf as the data controller. This includes collection and delivery addresses.
Unless you register using a social media account, the provision of your full name and email address is required from you to enable NYPY to register you as a Client.
NYPY will inform you at the point of collecting information from you, whether you are required to provide the information to us.
Information that you provide when registering to use the NYPY Service as a Courier (and any subsequent updates to that information), including:
Location-based and time-based events related to the deliveries will be collected automatically from your device, which is necessary as part of providing services to Clients. Other than where the app collects information automatically, NYPY will inform you at the point of collecting information from you, whether you are required to provide the information to us.
Information NYPY collect from other sources
If you register with the NYPY Service using a social media account, NYPY may obtain your email and full name from the social media site.
NYPY collect names and email addresses of contacts at potential Clients for the purpose of marketing and business development. This information may be found in a number of ways, including using online searches, LinkedIn profiles and word of mouth.
Lawful basis for processing
NYPY rely on legitimate business interest as the lawful basis on which NYPY collect and use your personal data.
Our legitimate business interests are performance of contracts with Clients, Couriers and our other customers and suppliers, marketing and business development and the administration and improvement of the NYPY Service.

NYPY routinely pass Client information to Couriers that they have booked (as set out in paragraph 5.14 of NYPY’s Terms of Business), and Courier information to the Clients who have booked (or are considering booking) their services.
NYPY may pass your information to our third party service providers, agents, subcontractors and other associated organisations for the purposes of completing tasks and providing services to you on our behalf (e.g. to host our servers, to send out newsletters or surveys on our behalf).
NYPY may disclose your personal data to any member of our corporate group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006 (where applicable).

Other than as set out above, and save in so far as is necessary in order for NYPY to carry out our obligations arising from any contracts entered into between you and NYPY, NYPY will not share your data with third parties unless NYPY have procured your express consent to do so.
Security
NYPY take appropriate measures to ensure that any personal data are kept secure, including security measures to prevent personal data from being accidentally lost, or used or accessed in an unauthorised way.
NYPY limit access to your personal data to those who have a genuine business need to know it.
Those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality.
NYPY also have procedures in place to deal with any suspected data security breach.
NYPY will notify you and any applicable regulator of a suspected data security breach where NYPY are legally required to do so.
Unfortunately, the transmission of information via the internet is not completely secure.
Although NYPY will do our best to protect your personal data, NYPY cannot guarantee the security of your data transmitted to or via the NYPY Service; and any transmission is accordingly at your own risk.

Keeping your personal data up to date
If your personal details change, you may update them via the NYPY Service or by contacting NYPY using the contact details set out upon websites providing the functionality of the NYPY Service.
NYPY will endeavour to update your personal data within five (≤5) working days of any new or updated personal data being provided to us, in order to ensure that the personal data NYPY hold about you is as accurate and up to date as is reasonably possible.
How long NYPY will keep your personal data.
NYPY will hold the personal data (as set out above)only for a reasonable period of time, having regard to the nature of the personal data and the purpose for which it was collected. In particular:
